First Advantage helps you navigate through these regulations to ease your
administrative burden. Employers covered by the DOT drug and alcohol testing
regulations MUST do all of the following:

Have a DOT drug and alcohol policy in place which articulates the specific
requirements of 49 CFR Part 40.

Train all supervisors of DOT covered employees to recognize potential drug abuse
and alcohol misuse

Provide information to all DOT employees on the hazards of substance abuse

Only use specimen collectors and alcohol testing providers who have received
training in the proper collection of DOT specimens
-
Use drug testing laboratories certified by the Substance Abuse and Mental Health
Services Administration (SAMHSA)

Use a Medical Review Officer (MRO) certified by a DOT recognized certifying body
-
Conduct random drug and alcohol testing pursuant to DOT requirements
-
Conduct post-accident drug and alcohol testing if the accident meets the DOT’s
“reportable accident” definition

Refer job applicants and employees to a Substance Abuse Professional (SAP) if their
drug or alcohol test comes back positive
